Amber Parking Regulations

The parking rules described in the regulations apply to drivers and passengers.
The rules are in place to ensure the safety of all parking users.

REGULATIONS FOR THE USE OF PARKING SPACES AND PARKING AREA.

Legal Parking Solutions Amber Parking as the manager (hereinafter: "Manager") establishes the following rules for the use of parking spaces at the car park at Kaszów ul. Pod lasem 6 (hereinafter: "Car Park"), which is part of the property (hereinafter: "Facility")

§1

Definitions

Parking Manager – Amber Parking

User – any person staying in the Car Park or leaving a vehicle in its area (agrees to the provisions of these regulations and undertakes to comply with their provisions)

Facility – parking lot behind the residential building Pod lasem 6 – parking for Amber Parking customers.

Barrier – a gate or barrier in front of the entrance to the property managed by Amber Parking.

Device for opening and closing the barrier /Key/ – remote control or GSM modem used to enter telephone numbers into the devices controlling the barriers before entering the property located in the Amber Parking office.

Parking – a part of the property designated and marked by Amber Parking, owned by the Company, consisting of many parking spaces, used for parking vehicles.

Parking space – a designated space in a parking lot intended for parking one vehicle

Vehicle – cars with a permissible total weight of up to 3.5 t

Two-wheeled vehicles – motorcycles, bicycles, scooters.

§2

General rules

1.Parking is payable every day of the year.

2.The parking lot is intended for parking passenger cars, motorcycles and bicycles.

3. Two-wheeled vehicles may only park in places designated for this purpose by the facility manager.

4. Exemption from parking fees applies to:

a) Amber Parking employees and vehicles

b) Amber Hostel employees and vehicles

c) employees and vehicles of KatDarOgródSystem

5. Amber Parking is a guarded car park, but it is not liable for any damage caused to the vehicles of persons authorised to park as a result of the actions of other persons authorised to use the facility.

6. The car park is open every day of the year.

7. In special cases, the Amber Parking Management Board is authorized to cancel the fee and thus the Parking Fee Imposition Protocol (PNOP)

8. The provisions of the Road Traffic Act of the Republic of Poland apply to car parks, access roads and internal car park roads.

§3

Parking Rules on

In the Facility/Zone/Parking Lot it is prohibited to:

1. Parking in a manner inconsistent with the Parking Lot markings.

2. Parking of vehicles by persons who do not have appropriate authorization from the facility management.

3. Littering the area, repairing vehicles, washing them, carrying out service work, including changing or adding oil.

4. Parking of unserviceable, mechanically inoperable vehicles.

5. Leaving the vehicle in unmarked parking places, e.g. on traffic routes, fire roads, pedestrian crossings and places marked with a no parking sign or in green areas.

6. Leaving vehicles in places marked with horizontal and vertical signs as places where stopping and parking is prohibited.

7. Leaving vehicles in places marked as disabled parking spaces without having a disability permit and without a visible vehicle marking.

8. Leaving vehicles in places where parking may pose a threat to the movement of vehicles, people or property, immobilize another vehicle or impede the exit of other vehicles.

9. Carrying out any activities related to the technical repair of the car, washing, changing oil or fuel, except for emergency situations and with the consent of the facility manager.

10. Performing other activities, in particular conducting service, advertising, commercial, etc. activities.

§4

Responsibility

1. The User is liable for any damage caused to the Facility, the Manager or other users of the Car Park in connection with the use of the Car Park.

2. The Administrator is not liable for any damage to the property of the User or persons accompanying him caused by the fault of other users or third parties.

§5

Parking Fees

1. In the event of any failure to comply with the provisions of these Regulations by the User, the Administrator shall be entitled to impose a parking fee of PLN 500 and to notify the Police or other appropriate law enforcement authorities.

2. The Amber Parking manager conducts the control of the compliance of the parking of vehicles in accordance with these Regulations, authorized by the owner. The parking lot is controlled and monitored.

3. The entity authorized to control compliance with the regulations is Amber Parking with its registered office in Krakow at ul. Krowoderska 5/1, through authorized employees, franchisees - belonging to the Amber group, with an official ID.

§6

Parking Fees/Appeals and Regulations

  1. A user other than those specified in §2 point 2 enters into a parking space rental agreement upon entering the parking lot. The agreement is valid for 24 hours from the moment the vehicle is parked. The rental fee (parking fee) depends on the duration of the stay and is determined by the administrator. The fee schedule is available at www.parkingamberbalice.com and on brokerage websites. The fee must be paid no later than the day the parking period begins, either via online payment or in cash on-site.

  2. Every driver has the right to submit a written appeal against the imposed parking fee within 3 days to Amber Parking. The appeal process follows the rules outlined in the received Parking Fee Imposition Protocol and can be submitted electronically via email at parkingamberbalice@gmail.com or by standard mail. The submission date is considered the date of sending the correspondence, whether electronically or by post.

  3. For an appeal to be considered, it is necessary to complete the Parking Fee Imposition Protocol and the starred sections containing personal data. A scanned or photographed copy of the completed protocol must be attached, along with a justification for the appeal. Submitting an appeal does not suspend the payment deadline.

  4. If the parking fee was paid on time and later canceled by the Parking Administrator through the appeal process, the refunded amount will be transferred back to the user’s bank account within the specified period from the date of the cancellation decision.

  5. Appeals submitted after the deadline, those that do not meet the requirements stated in §5 point 3, or those related to overdue payments, will not be considered and will be forwarded for debt collection.

  6. Electronic appeals are reviewed within 2 business days from the date of receipt, while postal appeals are processed within 21 days. (In the latter case, submitting an appeal does not exempt the user from the payment deadline.)

  7. Failure to pay for the service allows Amber Parking, based in Kraków, to initiate legal proceedings, including notifying the Police or other relevant enforcement authorities.

  8. The user agrees to the processing of their personal data and image by the administrator during surveillance registration of individuals violating the parking regulations, for the purpose of enforcing unpaid fees referred to in §5 point 7.

  9. Personal data is processed in accordance with Articles 13 and 14 of Regulation (EU) 2016/679 of the European Parliament and Council of April 27, 2016, regarding the protection of natural persons concerning personal data processing and the free movement of such data, repealing Directive 95/46/EC (“GDPR”).

  10. The personal data administrator is Amber Parking, based in Kraków.

  11. If the owner or user of the vehicle does not provide their details, they will be obtained through the Police, CEPiK (Central Vehicle and Driver Register), courts, or detective agencies. This is based on legal interest and the failure to pay for parking or additional services within the due date for the rented parking space.

  12. Personal data will be stored for the period necessary to pursue and enforce claims in accordance with applicable legal regulations.

  13. The Amber Parking administrator has the right to tow away a vehicle in cases specified by law, such as if the vehicle is left in a prohibited area or if its presence endangers the safety of other parking users.

  14. A penalty fee of 30 PLN per day (24h) will be charged for each day of delayed payment.

  15. If there is no contact with the vehicle owner and the vehicle remains parked beyond the rental period, the administrator will notify the Police and arrange for the vehicle to be towed to a secured police parking lot or retained at the current parking facility until all outstanding rental and towing fees are paid. This will be carried out in accordance with legal regulations and under the direction of the Police. In the event of towing, the user will be informed of the vehicle’s new location.

§7

Other provisions

These regulations were adopted by the manager of Amber Parking on 15 January 2025 and are effective from the date of adoption.

These Regulations have been developed to ensure the safety of their users, but also to maintain order and discipline, and above all to eliminate parkers who have nothing to do with the facility.

The regulations are effective from 15/01/2025.
